  1. DATA CONTROLLER

WACH & WACH ABOGADOS SLP (hereinafter, “WACH & WACH“) with registered office at C/Balmes 174, 4º – 2ªB, 08006 Barcelona, is the company responsible for processing the data collected or generated when accessing, using and browsing our website (hereinafter, the “Website“), as well as the data provided through the contact means available on Website.

  1. PURPOSE OF DATA PROCESSING AND CATEGORIES OF PROCESSED DATA

WACH & WACH will process the provided data manually and/or automatically and they will not be subject to automated decisions. The purposes of the processing are as follows:

  • Provide the commissioned legal services (these services may be provided directly by WACH & WACH or subcontracted); 
  • Send commercial information to Clients, adjusting such information to their profiles;
  • Manage profiles for potential incorporations/employments;
  • Manage commercial relationships with suppliers;
  • Fulfill legally established obligations or respond to requirements from competent authorities.

Given the established purposes, WACH & WACH will process (i) personal data (full name, postal address, email, phone, etc.); (ii) economic data (bank accounts, tax statements, etc.); (iii) data necessary for providing advice; and (iv) academic and professional data (education, qualification, professional experience and other relevant data for the selection of professionals).

The user of the Website (hereinafter, the “User“) must provide accurate data and is responsible for any damage caused by the lack of truthfulness in the provided data. Also, in case the User provides WACH & WACH with information about third parties, the User must declare to have the consent of these third parties to transfer the data to WACH & WACH and to have informed above mentioned third parties about this Privacy Policy, releasing WACH & WACH from any liability in this regard. In the event that the User does not provide all the necessary data for the proper provision of services, WACH & WACH does not guarantee the adequate and satisfactory provision of its services to the User.

  1. DATA RETENTION PERIODS

WACH & WACH will only retain the User information for the time necessary to provide the services that have been entrusted to WACH & WACH, as long as the consents granted are not revoked. Subsequently and only if necessary, WACH & WACH will retain the data for the periods legally established.

If the User has provided data in connection with a job offer or for the purpose of submitting an application, the data will be stored for at least one year from the date of the last update.

After the expiration of the retention period, the data will be securely deleted.

  1. IMPLEMENTED SECURITY MEASURES

WACH & WACH has implemented sufficient security measures to adequately protect your information. Security measures include technical security measures such as the encryption of communications between Users and WACH & WACH servers, as well as the encryption of information on these servers.

Generally, WACH & WACH will not transfer your data to third parties located outside the European Economic Area.

  1. DATA COMMUNICATIONS

In the context of the contractual relationship that the User maintains with WACH & WACH and in compliance with current regulations, WACH & WACH may be obliged to communicate personal data to public administrations (including courts), banks and financial institutions, other professionals for the proper provision of commissioned services or when such communication is necessary according to regulations and the law enforcement authorities.

  1. LEGITIMATION

The legal basis for data processing is the User’s consent and the provision and execution of contracted services. Additionally, it may be necessary to process data due to WACH & WACH’s legal obligations.

  1. USER RIGHTS

The User has the right to exercise, at any time and in accordance with current legislation, his/her rights of access, rectification or deletion of data, request the limitation of processing, object to it, request the portability of their data, and withdraw the consent given. 

To do so, the User must send a written request to the address C/Balmes 174, 4º – 2ªB, 08006 Barcelona or send it to the following email address: kancelaria@wachandwach.com. In order to provide a quick and effective response, the User must clearly indicate the right or rights they wish to exercise and provide their full name and identification document. Additionally, the User has the right to file a complaint with the Spanish Data Protection Agency (www.agpd.es; C/ Jorge Juan, 6, Madrid), although WACH & WACH encourages the User to contact the our Firm first.
